7.2 Beperkingen en vervolgonderzoek
Mijn onderzoek heeft betrekking op een zeer turbulente periode waarbij sprake is van een sterke volatiliteit op de financiële markten. Gedurende deze periode hebben vele gebeurtenissen plaatsgevonden die mogelijk een reactie op de markt teweeg hebben gebracht. Er bestaat daarom een mogelijkheid dat een gemeten significant abnormaal rendement niet is veroorzaakt door de door mij aangewezen gebeurtenis, maar door een andere gebeurtenis. Ik heb geprobeerd om dit risico zoveel mogelijk te beperken door onderzoek te verrichten naar verstorende gebeurtenissen. Verder heb ik mijn event window verkleint ten opzichte van bekende event studies. Het nadeel van deze keuze is dat ik mogelijk significante abnormale rendementen mis doordat deze buiten mijn event windows hebben plaatsgevonden en daardoor niet door mij worden opgemerkt. Mijn hypotheses zijn met name gebaseerd op de gevolgen die herclassificaties hebben voor het Tier 1 vermogen. Hierbij ga ik er van uit dat met name illiquide instrumenten geherclassificeerd zullen worden en verwacht ik dat de belegger hier positief op zal reageren omdat hij van mening is dat de reële waarde niet langer de fundamentele waarde representeert. Door de beperkte toelichting bij de herclassificaties, wat onderkent wordt door Ter Hoeven en Bout (2010), kan ik niet vaststellen of de herclassificaties ook daadwerkelijk illiquide instrumenten betroffen en kan ik mijn hypotheses hierdoor niet onderbouwen met bewijzen waardoor mijn hypotheses versterkt worden. Er bestaat een mogelijkheid dat de belegger op de nieuwsberichten heeft gereageerd om andere redenen dan ik verwacht. Vervolgonderzoek zal moeten uitwijzen wat de achterliggende reden voor de belegger was om te reageren.
De door mij gebruikte dataset is niet normaal verdeeld. Uit eerder onderzoek is gebleken dat bij uitvoering van parametrische testen in zo’n situatie mogelijk onterecht hypotheses worden verworpen. Ik heb dit risico opgevangen door tevens een non‐parametrische test uit te voeren.
Tenslotte blijven bij mij nog enkele vragen openstaan. Zo is mij niet duidelijk wat voor instrumenten door de banken werden geherclassificeerd vanuit de FVTPL‐ naar L&R‐categorie (paragraaf 4.1). Daarnaast ben ik benieuwd naar de achterliggende redenen van de manager om AFS‐debt instrumenten te herclassificeren. Op het Tier‐1 vermogen had deze herclassificatie in meerdere landen namelijk geen effect. Daarnaast verplaatsten de ongerealiseerde verliezen zich naar de toelichting waardoor een belegger nog altijd zelfstandig in staat was het resultaat inclusief ongerealiseerde verliezen te bepalen. Mijn vragen zullen in vervolg onderzoeken beantwoord moeten worden.

Appendix 1.
Onderstaand worden nieuwsberichten uit de Financial Times beschreven. De nieuwsberichten zijn gepubliceerd gedurende de periode maart 2008 – 13 oktober 2008 (Goedkeuring amendement). Uit de nieuwsberichten blijkt de discussie tussen bankiers, regelgevers en politici over toepassing van de accountingrichtlijnen voor financiële instrumenten. Na ieder nieuwsbericht geef ik de door mij verwachte tendens. De verwachte tendens is positief indien ik verwacht dat de belegger zijn verwachting van een amendement op IAS 39 positief zal bijstellen. In dit geval verwacht de belegger een wijziging. Is de tendens negatief dat verwacht de belegger dat de kans op een wijziging van IAS 39 afneemt.
Event 1: An unforgiving eye: Bankers cry foul over fair value accounting rules
Op 13 maart 2008 quote de Final Times AXA CEO Henri de Castries:
“If you are in the medical business, you want to be sure that the thermometer is the right one for benchmarking things properly. The accounting systems in the economy are the thermometer, and I’m not sure their measurement scale is the right one.” In hetzelfde artikel wordt aangegeven dat achter de schermen wordt gestart met een lobby door banken voor een wijziging van de reële waarde accounting richtlijnen:
The way that fair value accounting rules are being applied to the financial world. Indeed, behind the scenes some industry officials are already lobbying for change – and banking groups are discussing potential reforms. “We need to have a debate about whether the application of mark‐to‐market accounting to a wide range of assets creates some distortions,” says Charles Dallara of the Institute of International Finance, a Washington‐based banking group that is creating a reform blueprint. However, many accounting officials retort that these complaints simply smack of special pleading by the banks. After all, they argue, bankers were happy to describe these securities as “tradeable” when they were
packaging them for investors earlier this decade, or valuing them on their own books at ever rising prices. Thus these instruments do have a market price, even if the banks dislike where it now stands – or so the argument goes. “If you’d asked these financial firms six months ago, I think they’d have said ‘of course these securities are fairly valued,” says Michael McMurtry, partner at Eisner, the New York‐based accounting firm. “Now they recognise that probably wasn’t the case and they think the current values are too low. Hij is op dat moment hoofd van de IASB. Sir David Tweedie refereert in zijn artikel naar een discussion paper dat een dag eerder is gepubliceerd door de IASB. Het discussion paper behandelt het gebruik van Fair Value voor financiële instrumenten, en geeft aan dat hoewel Fair Value haar nadelen kent, het een disciplinerende werking heeft op een onderneming haar investering‐ en kredietbeslissingen.
Sir Tweedie vervolgt met aan te geven dat een historische kostenstelsel tot dezelfde pijn zou hebben geleid als nu onder Fair Value, door de impairment richtlijnen. Het artikel eindigt met een oproep tot discussie waarbij wordt gestreefd naar een betere standaard waarbij de onnodige complexiteit achterwege wordt gelaten.

Op 2 april 2008 schrijft de Financial Times dat drie vooraanstaande leden van het EFRAG, een groep experts die de Europese Commissie voorziet van adviezen inzake het aannemen van nieuwe accountingrichtlijnen, waarschuwen voor schaden aan de reële economie door de huidige
accountingrichtlijnen voor de waardering van financiële instrumenten. De waarschuwing wordt gezien als een van de eerste bemoeienissen van de politiek met de kwestie. Several insurers and bankers have complained about the rules, but this is one of the first signs of dissent within the accounting community. The three said the change “would increase confidence in the accounts themselves, which would no longer be affected by short‐term, day‐to‐day events”.
This week, Charlie McCreevy, European commissioner, said he believed there were “real accounting issues” that needed to be looked at, including the impact of fair valuing holdings in illiquid markets.

Event 4: Top banks call for relaxed writedown rules
Op 21 mei 2008 schrijft de Financial Times dat het IIF een voorstel heeft geschreven waarin het vraagt om versoepeling van de reële waarde accountingrichtlijnen teneinde de neerwaartse spiraal van grote afwaarderingen en fire sales tegen te gaan.
Het IIF is een wereldwijd samenwerkingsverband van banken. Een van de doelstellingen van het IIF is het ontwikkelen en bevorderen van representatieve standpunten en constructieve voorstellen waarmee het tracht het publieke debat te beïnvloeden op bepaalde beleidsvoorstellen, waaronder die van multilaterale organisaties, en grote thema’s van gemeenschappelijk belang voor deelnemers aan de financiële markten (IIF).
In het voorstel wat is verstuurd naar Amerikaanse en Europese centrale banken, regeringen en accounting toezichthouders, stelt het IIF voor regelgeving ten aanzien van de waardering van financiële instrumenten te wijzigen waarbij het banken mogelijk wordt gemaakt illiquide activa te waarderen op historische kosten teneinde de klap van de financiële crisis op te kunnen vangen. Hierbij wordt tevens aangetekend dat de bank het financiële instrument niet tot het einde van de looptijd hoeft te behouden om het instrument op historische kosten te waarderen. In het voorstel wordt aangegeven dat het mogelijk moet zijn om het activa na twee jaar weer te verkopen.
The IIF’s paper says: “The writedowns required under current interpretations may be substantially in excess of any actual or reasonably probable loss on many instruments”. Financial companies around the
world have been hit by more than $300bn in writedowns and been forced to raise more than $260bn from outside investors since last year, according to Bank of America analysts.
“Often dramatic writedowns of sound investments required under the current implementation of fair‐ value accounting adversely affect market sentiment, in turn leading to further writedowns...in a downward spiral that may lead to large‐scale fire sales of assets,” the IIF’s paper argues. Tendens: Positief Event 5: Big rewrite of accounting fair value ruled out Op 10 juli 2008 publiceert nieuwsagentschap Reuters een interview met Sir David Tweedie waarin hij ondermeer aangeeft dat er geen wijzigingen zullen plaatsvinden in de huidige regelgeving inzake de waardering van financiële instrumenten. In plaats daarvan zal de IASB de gebruikers voorzien van betere begeleiding over hoe de richtlijn toegepast dient te worden.
"We are certainly not thinking of any emergency measures to change what we do at present," IASB board chairman David Tweedie told Reuters on Wednesday evening’” .
Some want "circuit breakers", or a suspension of the rule in unusual circumstances. "The board is not going to do anything like that," Tweedie said. Tendens: Negatief Event 6: Josef Ackermann over convergentie IFRS en US GAAP Op 17 juli 2008 quote de Financial Times, Josef Ackermann, CEO van Deutsche bank en voorzitter van het IIF:
“It would be very important to have more convergence” between US and international accounting standards in the future, to create a transparent and level playing field. Deutsche Bank’s leverage ratio, he said, looked completely different under the two accounting regimes, while they also imposed different rules as to the reclassification of securities”.
Onder US GAAP richlijn SFAS 115 is het toegestaan in zeldzame omstandigheden financiële instrumenten te herclassificeren van een reële waarde categorie naar een historische kosten categorie. De financiële crisis valt onder de definitie van een zeldzame gebeurtenis. Zoals in hoofdstuk 2 beschreven, is herclassificatie onder IFRS niet toegestaan. Vele Europese banken zagen deze tegenstelling dan ook als een concurrentienadeel ten opzichte van de Amerikaanse banken. Indirect pleit Ackermann dus voor een herclassificatieoptie binnen IAS 39. Tendens: Positief Event 7 IASB calls credit crunch meeting Op 23 september 2008 schrijft de Financial Times dat de IASB een niet geplande vergadering zal houden waarin het enkele onderwerpen die verband houden met de kredietcrisis, waaronder reële waarde accounting, zal bespreken.
The meeting comes after the crisis on Wall Street has prompted fresh calls from banks and other financial institutions for regulators to ease their demands for “fair value” or mark‐to‐market, accounting where companies are required to mark their financial holdings at the current market value.
It is the first time that the International Accounting Standards Board has held an extraordinary meeting of this sort and reflects the current intense interest in accounting.
Many banks and insurers – including AIG, the US giant bailed out last week by the US government – have complained fiercely that the extreme market moves of the past year have caused them to write down billions in terms of “fair value”, leading in many cases to reported losses, even though they have no intention of selling the holdings and believe that prices will recover. Nicolas Sarkozy, French president, is to urge his European Union counterparts to back changes that would introduce more flexibility in the accounting rules. David Cameron, leader of the UK’s opposition Conservative party, said the rules had made the crisis worse and needed to be addressed. On Wednesday, Charlie McCreevy, the EU’s internal markets commissioner, said the bloc would follow if other parts of the world relaxed fair value accounting standards.
Mr Sarkozy will call for European leaders to agree a package of fresh financial market regulations, including “giving time to banks to smooth the effects” of the mark‐tomarket standards, said an official in Paris. We underline the necessity of avoiding any distortion of treatment between US and European banks due to differences in accounting rules. We take note of the flexibility in the application of mark to market valuation under IFRS as outlined in recent guidance from the IASB. Ecofin strongly recommends that supervisors and auditors in the EU apply this new guidance immediately. We also consider that the issue of asset reclassification must be resolved quickly. To this end, we urge the IASB and the FASB to work together on this issue and welcome the readiness of the Commission to bring forward appropriate measures as soon as possible. We expect this issue to be solved by the end of the month, with the objective to implement as of the third quarter, in accordance with the relevant procedures. In this context, the Council reached the following conclusions.
