6.8 Slotbeschouwing: de toekomstbestendigheid van de Wdkb
Deze tweede evaluatie van de Wet donorgegevens kunstmatige bevruchting laat een gemengd beeld 12
zien. Aan de ene kant zijn er sinds de eerste evaluatie met name door de klinieken verschillende 13
verbeteringen doorgevoerd, onder meer in de registratie van gegevens van donoren. Aan de andere 14
kant zijn veel van de aanbevelingen die zich destijds richtten tot de SDKB niet uitgevoerd. De 15
knelpunten die destijds zijn gesignaleerd rond het functioneren van de stichting bestaan nog steeds. 16
Inmiddels is een wetswijziging in voorbereiding waarin een aantal aanbevelingen ter hand wordt 17
genomen zoals de koppeling van registraties van donoren die bij meerdere klinieken hebben 18
gedoneerd. Die wetswijziging brengt op een aantal van de in deze evaluatie geconstateerde 19
tekortkomingen echter geen verandering. De toekomstbestendigheid van de Wdkb en de kans dat de 20
wet slaagt in het realiseren van zijn doelstellingen hangt voor een belangrijk deel samen met een 21
andere taakopvatting door de SDKB. Zonder een meer betrokken en ook proactieve taakvervulling is 22
de toekomstbestendigheid van de Wdkb onvoldoende gewaarborgd. Het verdient aanbeveling dat de 23
minister zich spoedig beraadt op het gebleken functioneren van de SDKB en dienaangaande 24
maatregelen neemt, teneinde de belangen van allen die zijn betrokken bij het tot stand brengen van 25
donorzwangerschappen in de vereiste mate te eerbiedigen. 26
