Notification regarding the tariffs applicable as of

1 September 2003 and 1 July 2003, respectively,

for KPN’s interconnection and special access

services (II)

1. Background

In its notification of 30 June 2003 (reference: OPTA/IBT/2003/202419) the Commission of the

Independent Post and Telecommunication Authority (hereinafter: the Commission) informed the market parties that the procedure for approval of the cost allocation systems with which KPN determines its tariffs for the period 1 July 2003 to 1 July 2004 (originating services) and for the period 1 September 2003 to 1 September 2004 (terminating services), respectively, had not yet been formally concluded. At that time, the Commission expressed its expectation that the assessment would be concluded within a number of weeks.

The Commission has since concluded said assessment and wishes to inform the market parties as follows.

2. Assessment results

Above-mentioned assessment has resulted in the Commission’s decision not to approve the cost

allocation systems used by KPN1. This decision2 was submitted by the Commission to KPN on Thursday, 24 July 2003 (after exchange closing). This notification was published on the OPTA website shortly

thereafter.

KPN was requested to check the text of the decision of 24 July with reference to business-confidential information. The Commission will evaluate the passages that KPN claims contain business-confidential information and will publish a public version of the decision based on this evaluation. This publication is expected sometime in the middle of the coming week.

KPN for the services it provides with reference to interconnecting leased lines, collocation and bitstream access. Therefore, the refusal of approval as referred to here does not cover these tariffs.

3. Cost-oriented tariffs

In order to already inform the market of the cost-oriented terminating access tariffs as resulting from the BULRIC-III cost allocation system as the Commission believes results in cost-oriented tariffs for the period 1 September 2003 to 1 September 2004 if KPN had submitted that system to the Commission for its approval, the cost-oriented terminating tariffs that would apply in that case are listed in Appendix 1. Appendices 2 and 3 contain the cost-oriented originating access tariffs as would be applicable if KPN had applied the EDC-VI cost allocation system in accordance with the Commission’s assessment.

The Commission intends to take enforcement measures in the event that KPN applies tariffs other than these cost-oriented tariffs to the parties that interconnect with KPN.

Specifically with reference to the services provided regarding unbundled access to the local loop, it must be noted that the Commission has ordered KPN in the above-mentioned decision in accordance with Section 4, second subsection of the Regulation3 to include the cost-oriented tariffs as listed in Appendix 3 in its reference offer for the services listed in Appendix 3 for the period from 1 July 2003 to 1 July 2004.
