TRUCE AGREEMENT.

NETHERLANDS DELEGATION.

17 January 1948.

COMMITTEE OF GOOD OFFICES ON THE INDONESIAN QUESTION.

Conference with the Delegations of the Govemments of the Nelherlands alld the Repubtic of Indonesia.

Truce Agreement between the Govemment of the Nelherlands and the Government of Ihe Repubtic of Indonesia signed at the fourth

meeting on 17 January 1948.

The Governmcnl of Ihe Kingdom of the Nclherlanels allli Ihe Governmelll of Ihe Repllblie of Indo.nesia, rcferred to ill lliis agreement as Ihe parlies, herchy agrec .?IS follows:

I. This order will apply to . the troops of both parties along the bounelary lines of the areas eleseribeel in Ihe proelamation of the Netherlanels Inelies GovernmeJlt on 29 August 1947. IVhieh shall be ealled the siolIls '1"0 IiJle, and in Ihe areas speeifieel iJl the following paragraph.

2. That in the first instancc and for Ihc time lJeing, dcmilitarizcd zones be established in general w nformity wit'l the above-mentioned slalus quo line; these zones as a rule will eomprise tlle territories bet ween lliis siallIs quo line and, on one siele" the line of tlle Netherlands forward positions anel, on the otller side, tlle line of tlle Republiean forwarel positions, tlle average wielth of eaeh of tlie zones being approximately the same.

3. Thai Ihe eSlablishmenl of Ihe demililarizeel zones in na way prejudices Ihe rights, claims or position of Ihe parties under the resolutions of the Seeurily Couneil of I, 25. a,nel 26 August and I November 1947.

4. 5. That, peneling a polilieal settlel1lent, the responsihility for Ihe mainlc- nanee of law anel order ancl of security of life and property in the demilitarizecl zones \ViII remain vcsted in the eivil police farces of the respeetive parties.

(The lerm eivil poliee does not exclucle the temporary use of military per- sonncl in the capacity of civil police, il heing unelerstoocl that the poliee forees

lViii be under civil controi). The COnllnittee's military assistan/ts lViII be avail- able to advise the appropriate authorities of the parties a'lel 0 serve in such other proper capacities as may be requested. Among others they should:

(iI) cal1 upon pools of police officers established byeach party in its demili- tarizcd zone to accompany the military assistants in meir endeavours allli moves throughout that demilitarized zone.

Police officers of one party wil1 not move into anel throughout the delllili- tarized zo,ne of the other party unless accompanied by a military assistant of the COllllllittee of Gooel Offices and a police officer of th at ot her party.

(b) prolllote cooperation between the two police farces.

6. That trade and intercourse between al1 areas shoqlc1 be permitted as far as possible; such restrictions as may be necessary will be agreed upon by the parties with the assistance of the Committee ancl its representatives

if required.

7. That this agreement shall include all the following points al ready ag reed to in principle by the parties:

(a) Ta prohibit sabotage, intimielation anel reprisals anel ofher activities of a sil11i1ar nature against individuals, groups of individua ,and property, including destruction of property of any kind and by whomsoever olVned, anti to utiJize every ll1eans at theiT cOllll11and to this end.

(b) To refrain from broadeasts or any other farm of propaganda aimed at provokillg or disturbing troops anti civilians.

(c) Ta initiate broaelcasts and i"stih,te other measures to info"n al1 troops and civilians of the delicate situation anel the ,necessity for strict complianee with the provisions sub (a) anel (IJ).

(d) Fulr opportunity for observation by military and civil assistants made available to the COlllmittee of Good Offices.

(e) 1'0 cease imilleeliately the publicatioll of a daily operatiollal colllllllll,ique or any other iliformatiCl'l about military operations lmles~ by prior agree-

ment in writing, except wcekly publication of lists of individuals (giving names, numbers allu home addresses) who have beell killed or have died

8. That, On the acccptancc of the for~going, the COl11l11ittee's military assistants will illll11cdiately conduct cnquiries to establish wh tiler and where, especially in West Java, eleillents of the Rcpublican military forces continue to offer resistance behind the present forward positions of the Netherlancls farces. If the enquiry establishes the existellce of such for s, these should witl1Clraw as quickly as practicabie, anti in any case within ~1 days, as set Olll

9. CLARIFICATION OF THE AGREEMENT.

I. As rcgartls paragraph I of the forcgoing agreelllent, it is l1l1c1erstood that Ihe Iwo parties \ViII el1deavour to implement the various points of the tl"UCC agreement without any delay anc! with all I11cans at their disposal;

it is eqllally lInderstood that, should one ol Ihe parties meet wilh special dilficullies in earrying out fully within a few days any obligation imposed

\lpon it by the truce agreement, upon Ilolification to the other party the ti{llC

limit of forty-eight. (48) houes provided in the first article of the proposals will be extended up to a maximum of twelve (12) days.

2. As regards paragraph 2 of the furegoillg agreement, it is uncJerstoocJ that if, as expeclecJ, Ihe truce agreement is increasingly implementecJ and vhe gelleral situatioJl contilllics to clcvelop favourably, the clemilitarizecl zones wil1, as a matter of course, be hlrther extended. The question of an extension of 'Ielllilitarized zones wil I "pon Ihe request of either party, be mnsidered forth- with by thc COll1l1littee's 1llilitary assistallts who, acting within the intent of paragaraph 5, will advise Ihe appropriate authorities.

Preliminary cease hostilities order under the truce agreement.

Adopted at the fourth meeting on 17 January.

Tuday a truce was sigIled betweell the clelegatiolls of the Rcpublic uf Indonesia alld the Netherlallels on board the U.S.S. Renviiie. This means that as soon as possiblc all measures will be taken to put an enel to all hostilities in the most cffective way. Whilc awaiting the detailcd orders ancl instructi<J,ns I order you as follows:

(I) Avoid any provocation in whatever farm.

(2) Continue to carry Out you!' task for the Il1élÎllh:r;aIlCl: of law alld order in the arcas :tssignecl fo YOll.

(3) Delelld yourself if attacked.

(4) Avoid all illcidellh.

(5) Realize that yOu remaill respollsible for the safety of life and property.

A. Genera!.

1. These regu[ations will be issued at 21.00 hours Ol} the aay of the signillg of the truce agreement allel will become operatiovc or both parties fourtecn (14) days' thereafter at 24.00 hours on that day. A this moment all Itostilities in the forwa.rd areas (s'ee para 8- 10 bel uw) shal 'have dehnitely ceascd, with due observancc of these regttlations alld direct yes.

IVhich lVere not mentioned in the 29 August 1947 Proelamation, the Status Quo Line should be broughr further west to coincide with the administrative boundaries of Purbalingga Regency a nel GOlrfuoog District.

The Netherlands representative was of the opinion that, s','1ce the Status Quo Line in the Kemit area had been clearly marked out on a map IVhich lVas presenteel to tlle Committee of Good Offices as an annex to the General Regul- fltiol1s UllClcr the Trucc Agreement, it was not necessary to have the line changed. 2. the Netherlands view that the Status Quo Line should follow that which was e1early indicated on the map as an annex to the General Regula,tion u'ncler the Truce Agreement.

Since the nature of the di~pute ilwolved matters which could only be decided by the higher authorities of bath partics, the Sub-Coml11ittee reports

these differing views to the Security COll1mittee for its decision.

In th is ar'ea, a clispute had ariscn at tile second meeting between the local commanders of the parties and the military assistant of the COl11mittee of Good Offices, when the Netherlands local commander suggested that the Status Quo Line in this area should be drawn sa as to include the wllOle of a kampong area lor administrative reasans, although the line as delined on the map annexed to the General Regulation under the Truce Agreement elivided the kampong area in two parts and 'had been sa agreecl upon cluring the lirst Gubug meeting of the local commanders with the military assistant of the COll1l11ittee ol Good Offices.

After having discussecl the situation, the SlIb-Col11mittee agreed to recol11mend that the Status Quo Line in the Gubug area should be established
