This total amount of DM 154.486,50 vill be included into the Letter of Credit to be opened and will be paid out correspondingly with each of the instalments.
ARTICLE Y Delivery
1) SELLER undertakes to have ready the material for the first shipment after .. , whereas the total delivery FOB of the material as per "Amendment I" has to be completed within months, all after receipt of the advance payment out of the Letter of Credit as per Article IV, subject to "Force Majeure" (Article V I ) , and to the fact that there are no technical changes.
2) Article VII (Penalty) shall only be related to deliveries
exceeding the final delivery date as indicated under paragraph l),
