HER Majesty the Queen of thc United Kingdom of Great Britain and Ireland, Empress {If India, and Her Majesty the Queen-Dowager, Regent of the Netherlands, in the name of Her Majesty Wilhelmina, Queen of the :Netherlands, being de- sirous of defining the boundaries between the N etherland posses- sions in the Island of Borneo and the States in that island which are under British pro- tection, have resolved to con- clude a Convention to that effect, and have appointed as their Plenipotentiaries for that purpose, that is to say:

Her Majesty the Queen of the United Kingdom of Great Britain and Ireland, Empress of India, the Right Honourable Robert Arthur Talbot Gascoyne eecil, Marquis ofSalisbllry, Earl of Salisbury, Viscount Oran- borne, Baron Cecil, Peer of the United Kingdom, Knight 0f the Most Noble Order of the Garter, Member of Her Majesty's Most Honourable Privy Council, Her Majesty's Principal Secretary of State for FOIeign Affairs, &c.;

and HCT Majesty the Queen-

H ARE ~lajesteit de Koningin van het Vereenigd I(oninkryk van Groot BrittanIlie en Ierland, Keizerin van Indie, en Hare Majesteit de Koningin Weduwe, Regentes der N ederJanden, in naam van Hare ~1ajesteit \Vil- helmina, K.oningin der Neder- lallden, wenschende de grenzen vast te stellen tusschen de N ederlandsche bezittingen op het Eiland Borneo en de Staten op dat eiland die onder Britsch Protectoraat staan, heb ben t:wed-. gevonden tot dat doel een ver- drag te sluiten, en hebben te dien einde als Hare Gevol- machtigden benoemd, te weten:

Hare M ajesteit de Koningin van het Vereenigd Konin l<ryk van Groot Brittannie en Ierland, Keizerin yan Indie, den Heel' Robert Arthur Talbot Gascoyne Cecil, Markies van Salisbury, Graaf van Salisbury, Bllrggraaf Cran borne, Baron Cecil, Pair van het Vereeni~d Koninkryk, Riclder van de Orde yan den Kouseband, Lid van Harer Ma- jesteit's Geheimen Raad, Harer Majesteit's voornaamsten Secre- taris van Staat voor Buiten- landscbe Zaken, enz.; en Hare

Dowager, Regent of the N ether- lands, Count Charles Malcolm Ernest Georges de Bylandt, Knight Grand Cr0ss of the Order of the Netherland Lion, Her Majesty's Envoy Extra- ordinarv and Minister Pleni- potentiary at the Court of St. James'; who, having pro- duced their Full Powers, found in good and due form, have agreed UpOIl the following Ar- ticles : -

ARTICLE

1 :

The boundary between the N etherl::md possessions in Borneo and those of the British- protected States in the same island shall ~tart from 4° 10' north latitude on the east coast . of Borneo.

ARTICLE 1I.

The boundary-line shall be continued westward from 4° 10' north latitude, and foIJow in a west-north-west direction, be- tween the Rivers Sim.engaris and Soedang, np to the point where the meridian 117° east longi- tude crosses the parallel. 4° 20' north latitude, with the view of including the Simengaris River within Dutch territon'. The boundary-line shall th~n follow westward the parallel 4° 20' north latitude until it reaches the ~um mit of the range of mountains which forms on that parallel the watershed between the rivers running to the north- west coast and those running to the east coast of Borneo, it heing understood that, in the eyent of the Sirnengaris River or any other ri,oer ,Rowing into the sea helo',y 4° .10', being

ART1KEL I.

De grens tusschen de Neder- landsche bezittingen op Borneo en die der tot het Britsch Pro- tect.)raat behoorende staten op dat eiland zal aanvangeu op 4° 10' noorder breedte op de oostkust van Borneo .

ARTIKEL 11.

De grenslyn zal van 4° 10' Boorder breedte westwaarts ver~

volgd worden, en in eene west- noord westelyke jOichting loopen tusschen de Simengaris en Soen- dang rivieren tothet punt waarde meridiaan van .117° oosterlengte van Greenwich de parallel 40

noorder breedte snydt, met het doelom de Sirnengaris rivier tot het N ederlandsch grondgebied te doen behooren. De grenslyn zal dan westwaarts tie parallel 4° 20' noorder breedte volgen tot dat zy het hoogste punt bereikt van de bergketen, welke op die parallel de waterscheiding vormt tusschen de rivieren die naar de noordwestkust, en die welke naar de oostkust van Borneo afstroomen, met dien verstande, dat ingeval de Simen- garis rivier of eenige ·andere rivier, welke ten zuiden van

ARTIKEL Ill.

Van het hoogste punt van de bergketen bedoeld in Arlikel 11 t.ot Tandjong - Datoe aan oe westkust van Borneo zal de grenslyn de waterschieding voigen van de rivieren die af- stroomen naar de noordwest en westkusten benoorden Tand- jong-Datoe, en van die welke afstroomen naar de westkust hezuiden Tandjong-Datoe, de zuidkust en de oostkust be- zuirlen 40 10' noorder breedte.

ARTIKEL IV.

Van 4-0 10' noorder breedte ter oostkust zal de grenslyn oost waarts yer\'olgd worden langs die parallel over het eiland Sebittik; het gedeelte van dat eiland dat gelegen is ten noorden van die parallel zal onvoor- l\'aardelyk toebeho()ren &an de Britsche Nooro Borneo Maat- sehappy, en het gedeelte ten zuiden ,'an die parallel aall Nederland.

ARTICLE V.

The exact positions of the boundary-line, as described iu the four preceding Articles, shall be determined hereafter by mutual agreement, at such times as the N etherlancl and the British Governments may think fit.

ARTICLE VI.

The navigation of all rivers flowing iuto the sea between Batoe-Tinagat and the River Siboekoe shall be free, except for the transport of war material;

and no transport duties shall be le\'ied on other goods pnssing up those rivers.

ARTICLE VII.

The population of Boelongan shall be allo\\ed to collect jungle produce in the territory between the Simellgaris and tile "'rawao Ri vers for fifteen years from the date of the signature of the present COlwention, free from any tax or duty.

ARTICLE VIII.

The present Convention shall be ratified, and it shaH come into force three months after the exchange of the ratifications, which shall take place at London one month, or sooner if possible, after the said Oonvention shall have received the approntl of the N etherland States-General.

De juiste ligging van de grenslyn in de vier voorgaande Artikelp.n ornschreven, zal later in onderling overleg worden aangewezen op de tydstippen die de N ederlandsche en Britsche Regeeringen daarvoor geschikt zullen oordeelen.

ARTIKEL VI.

Descheepvaart op aUe rivieren die tusschen Batoe-Tinagat en de Siboekoe-rivier in zee uit- monden zal vry zyn, uitgezon- derd voor het vervoer van oorlogs- materieel, en op het vervoer van andere goedereo, welke deze rivieren opgevoerd worden, zullen geen rechten geheven worden.

ARTIKEL VII.

Gedurende vyftien jaren, ge- rekend van den dag der onder- teekening van deze Conventie, zal het aan de bevolking van Boelongan vrystaan boschpro- ducten te verzamelen in het gehied tusschen de Simengaris en Tawao rivieren, vry van belasting of welke andere heffing ook.

ARTIKEL VIII.

Deze Convcntic zai bekrach- tigd ,vorden en zy zal in werk·

ing komen drie maanden na de uitwisseling del' ratifica6en, die zaI' plaats hebben te Londen eene maand, of zoo rnogelyk vroeger, nadat de Conventie de goedkeuring der Nederlandsche Staten Generaal zal heb ben verkregen.
