Our understanding of regime interaction

•  Interactions can be:

1.  Conflicting 2.  Synergetic 3.  Neutral

•  Factors influencing interactions:

1.  Drafting periods

2.  Different institutional structures

3.  Existence or lack of parallel membership

4.  Divergent (and sometimes competing) interests

•  Three characteristic dimensions of regime interaction:

1.  Interaction of goals

2.  Interaction between institutions

3.  Interaction between legal norms (treaty conflicts)

(4)

Expected results and contribution to the field

•  Develop a new line of research

•  Theory of interest- and regime- interaction in ocean governance

1.  how the relevant legal frameworks interact 2.  how to solve possible tensions/incoherencies

between the legal frameworks

3.  how energy and climate change law are re- shaping ocean governance

•  Develop legal tools

•  Develop a research database

1st Workshop – Regime Interaction in

Ocean Governance: Problems, theories and methods (19-20 April 2018)

•  Twofold aim:

1)  dissecting the concept of ocean governance in order to have a better understanding of the regime interaction taking place therein;

2)  testing one of the premises of the project

Regime interaction in international law does not consist necessarily of a problem to be solved but of a

phenomenon to be better understood so as to be also (sometimes) benefitted from.

(7)

•  Structure of the workshop

•  Session I – The Many Facets of Ocean Governance

•  Understand / delimite ocean governance

•  Identify the problems

•  Session II – Theoretical approaches to regime interaction and international governance

•  Explore theoretical approaches

•  Get inspired

•  Session III – Methods of interaction

•  Identify patterns of interactions

•  Analyse existing and potential legal tools / method

(8)

2nd Workshop - Theory of interest- and regime- interaction in ocean governance at the test of the practitioners (Winter 2019-2020)

•  Preparatory work:

1.  Map interests and identify relevant stakeholders

•  Series of (small) meetings 2.  Draft briefs/recommendations

•  Twofold aim:

1.  Present some of the final results of the research team

•  PI and two PhD students

2.  Receive feedback from the practitioners

•  Theory and legal tools

(9)

SustainableOcean Database (pilot)

•  Brings together academic sources related to the three main dimensions of the project

•  Suitable for practitioners, researchers and students

•  Selected bibliography

•  Open to audience comments and suggestions

•  Pilot: https://sustainableocean.sites.uu.nl/
