Hart and the Oxford Jurisprudence Circle: Rediscovering the Lost Legacy of Customary Law by Andreas Hadjigeorgiou

1. The concept of customary law that was developed by Hart’s predecessors in Oxford is of immense value in understanding international law.

2. Rereading Hart’s work through the legacy of his predecessors reveals a new, hitherto undiscovered Hart.

3. Hart never questioned the legality of customary (international) law.

4. Hart used Malinowski’s work to construct a concept of (international) law in the way his predecessors envisioned.

5. Hart, his predecessors and Malinowski can all be labelled ‘evolutionary positivists’.

6. Hart’s account of (customary) international law as ‘law but not a legal system’ perfectly reflects core aspects of international legal practice and will prove invaluable for international legal theory.

‘Hart en de vergeten nalatenschap van de Oxford Rechtsfilosofische Kring: een rehabilitatie van het gewoonterecht

1. Het concept van gewoonterecht, dat door de voorgangers van Hart in Oxford is ontwikkeld, is van enorme waarde voor het begrijpen van internationaal recht.

2. Het herlezen van Harts werk in het licht van de erfenis van zijn voorgangers onthult een nieuwe, tot dusver onontdekte Hart.

3. Hart heeft de legaliteit van het (internationale) gewoonterecht nooit in twijfel getrokken.

4. Hart gebruikte Malinowski’s werk om een concept van (internationaal) recht te construeren op de wijze zoals zijn voorgangers zich dat hadden voorgesteld.

5. Hart, zijn voorgangers en Malinowski kunnen allemaal als ‘evolutionaire positivisten’ worden bestempeld.

6. Harts typering van internationaal (gewoonte)recht als ‘recht maar geen rechtssysteem’ weerspiegelt perfect de kernaspecten van de internationale juridische praktijk en zal van onschatbare waarde blijken voor de internationale rechtstheorie.
