Bijlage 1 Voorbeeld van een octrooipublicatie
In het geval een uitvinding geoctrooieerd is moet het worden gepubliceerd op papier, CD-rom of internet. Zo’n publicatie heeft een zevental standaardonderdelen die in alle octrooipublicaties ter wereld teruggevonden kunnen worden: Titel, samenvatting, achtergrond van de uitvinding, doel en voordelen van de uitvinding, beschrijving van de tekeningen, de tekeningen en de claims. Eén van de databases waarin deze publicaties zijn opgeslagen is die van het Amerikaanse octrooibureau (United States Patent and Trademark Office). Hieronder staan een aantal fragmenten van een octrooipublicatie uit deze database van een vacuümzuiger voor wijnflessen van de uivinder Logue met bijbehorende uitleg (Ardis
i, 1991). Omdat deze literatuur Engelstalig is, is de inhoud onvertaald gelaten.
Title: A brief restatement of the title reflecting the main element of the

Abstract: A brief synopsis or summary of the invention:
Background section: A brief statement concerning the general and specific field or area of the invention, including cross-references to related
applications; relevant prior art; a list of related applications filed by the inventor, if relevant; and a discussion of prior art or how the invention related
to previous attempts to solve the problem:
Objectives and advantages section: A summary of the invention. The term
objectives refers to “what the invention accomplishes”and should include a
discussion fo the advantages of the invention over previous inventions.
Description of drawings: A series of separate paragraphs describing the drawings. The applicant for a patent is required by law to furnish a drawing of the invention whenever possible or relevant:
Drawings: Drawings which must show every feature of the invention specified
in the claims and must contain as many figures and views as necessary to
show the invention:
Claims: Claims recite and define the structure of an invention in precise, logical terms. They point out and distinctly claim the subject matter that the
applicant regards as his or her invention. Therefore, the purpose of the claims is to discuss and delineate the scope of legal protection geiven the invention.
This means that the concepts of novelty and patentability are judged by the
claims, not the disclosure. Consequently the claims are the operative part of
each patent:

Bijlage 3 Methodiek voor het analyseren van octrooiliteratuur
Deze bijlage is gebaseerd op Engelstalige literatuur (Brockhoff
ii). Om de
oorspronkelijke strekking van deze literatuur zoveel mogelijk recht te doen is de inhoud onvertaald gelaten.
Plot of patent position
Cross-se ctional data are analysed for a certain period of time to compare between possibly competing firms on specific variables. Four variables have proven to be valuable in cross-sectional studies of overall patent data:
1. Total number of patent applications within a certain period.
2. Application success rate. This relative number indicates the degree to which an applicant has been successful in having patents granted.
3. Examination rate = examinations in progress / (patent applications – patents granted)
4. Waiting time (reciprocal value). This is the time period between date of application and granting of a patent.
The score on each of these four variables can be plotted in a graph. The figure below is plotted to compare the data from three German automobile manufacturers.

Brockhoff presented these four variables to the R&D management of these three competing firms and observed much discussion. This figure shows what a SME can learn from patent publications. For instance deriving the R&D output of competitors

by counting the number of patent applications in a certain period and considering the success rate.
Brockhoff also suggests that a classification by technological fields is more relevant for the evaluation of competitive positions than a classification by patent classes. The relationship between both classes can be formulated by using boolean operators so that the patents can be automatically allocated to these fields.
Patent portfolio method
Similar to the well-known market or product portfolios a patent portfolio (see figure) can be drawn based on three variables:
1. Number of patents applications by one firm relative to the number of applications of its most active competitor in a certain field of technology (x- axis, logarithmic scale).
2. Growth of a technological field as measured by patents during the past four years relative to the growth in the preceding 16 years (y-axis, logarithmic scale).
3. Relative number of patent applications in a technological field as related to the total number of patent applications by the firm under consideration (bubble size).
Each bubble has a different colour referring to a distinct technology field.

The example above shows that the firm has put a lot of technological effort into slowly growing fields (bubble size = 4), where it was able to attain a strong technological position (bubble size = 2) relative to its competitors. In one strongly growing field the firm owns a relatively large number of patents, which is however dominated by a much stronger competitor. An important question is: ‘How will the portfolio look in three years from the present? Some hints per variable will be worked out below:

An example for the German automobile manufacturers mentioned above will be given below to explain how it works. Assume that the above patent portfolio makes a comparison between manufacturer A and its competitor manufacturer B. Another assumption is that manufacturer A has 15 patents applicated in total and three of them in the field of, for example, ‘gearboxes’ (the most left bubble). The relative patent position in technology field is 0,2. This means that manufacturer B has (3 / 0,2
=) 15 patents applicated in the technology field of ‘gearboxes’. The general growth of that technology field is 30 what means that the growth during the past four years relative to the growth in the preceding 16 years is 30 times higher.
Now the question is: “How will this portfolio look like in three years?”. The relative patent position can be derived from comparing the average waiting time for
manufacturer A and B corrected by the application success rate. If we look at the plot of the comparative total patent position, manufacturer A is represented by the dotted line and manufacturer B by the striped line. The average waiting time for A is (1 / 0,11) 9,3 time-units and the application success rate is 0,22. The average waiting time for B is (1 / 0,21) 4,7 time-units and the application success rate is 0,88. The average waiting time for B is also (4,7 / 9,3 =) 0,5 times smaller than that of A.
Moreover the application success rate is (0,88 / 0,22 =) 4 times higher than that of A.
Both variables also indicate that the relative patent position of A will decrease compared to B. O course not only these variables are influencing the relative patent position. Number of patent applications, examination rate and information on R&D expenditures of manufacturer B are important variables too. If the growth of technology field with value 30 will increase or decrease can be inferred from for example expert rating. Assume that this growth will decrease to 10 the next three years.
The future relative number of patent applications in a technological field as related to
the total number of patent applications by firm A is a decision variable. Given the
above mentioned variables the R&D management of manufacturer A should decide
about the structure of the patent portfolio. Unwanted portfolio structures would then
have to be corrected by changes in the R&D policy. In the case mentioned above,
both the relative patent position and growth of technology field decrease as the
bubble will shift left downwards. For that reason it is better to decrease the number of
patent applications in that field.
