ABSTRACT
This thesis concerns Sierra Leone Faintly Law. The law is examined from the viewpoint of the pluralistic system - general, Islamic and customary laws - applicable in the country. The
thesis is divided into three Parts. This being a pioneering
A
work, it is necessary to give first an explanatory outline of the country and its legal system and how family law works within that system. Part One, which contains four chapters, is devoted to this preliminary explanation.
The Second Part deals with non-customary family law. It is mainly an analysis of the general law and Islamic law, but it also considers specific areas in family law in which there are conflicts in the pluralistic legal system . The highlights of this Part are: statutory marriage (Chapter 5); the essentials
j
i of a valid statutory marriage (Chapter 6); matrimonial relations
(Chapters 7 and 8 ); matrimonial property (Chapter 9); raatri-
i
monial reliefs (Chapter 10); termination of marriage (Chapter 11);
the parent-child relationship (Chapter 12); and succession to property under non-customary law (Chapter 13).
Part Three discusses customary family law. The inform
ation contained in this Part is derived partly from previous pub- j lished and unpublished sources, and partly from the personal field investigations of the present writer. The method of exposition of the customary laws is by topics rather than by ethnic groups, though with each topic, ethnic/local variations are indicated where relevant. This Part begins with an introduction showing how the present writer collected his data on customary law.
i
Chapter 14 examines the nature and character of customary-law marriage. Chapters 15 and 16 analyse the formation of a custom
ary-law marriage and the essential requirements for such marriage
ii.
respectively. The husband and wife/wives relationship in the compound/polygamous family is dealt with in Chapter 17. Chapter
18 discusses the termination of a customary-law marriage. The parent-child relationship under customary law is examined in Chapter 19. Finally, Chapter 20, dealing with succession under
customary law, concludes the thesis.
ACKNOWLEDGEMENTS
This work would not have been completed had it not been for the help and encouragement of a number of people and insti
tutions*
First, mention must be made of Professor A.N. Allott, Professor of African Law and Head of the Department of Law,
School of Oriental and African Studies, University of London, who supervised the work* I benefited much from Professor Allott* s criticisms; and his profound knowledge of African Law was an
inspiration to me throughout the time I spent on the thesis*
Dr* Doreen Hinchcliffe, Lecturer in Islamic law at the j
School of Oriental and African Studies, also deserves mention*
She clarified issues relating to Islamic law generally and, in particular, she gave me a thorough and stimulating insight into Maliki law*
Next, the United Kingdom Scholarship Commission was gener
ous in granting me a Commonwealth Academic Staff Scholarship for the 1972/73 Academic year, which lightened my financial burden*
Acting jointly with the Commission, the Association of Common
wealth Universities and the British Council took especial inter
est in my welfare and that of my family while in Britain*
Professor, the Rev* Canon Dr* H.A.E. Sawyer, Principal of Fourah Bay College, University of Sierra Leone, was very keen to see this work completed and he demonstrated it by enabling me,
in the face of many odds, to take a year’s leave of absence from the University of Sierra Leone*
The services of Miss E* Hoffmann of the Area Studies
Centre, School of Oriental and African Studies, and Mrs* M* Baker, of 4 Northwood Gardens, Clayhall, Ilford, Essex, should also be
iv.
put on record. Miss Hoffman assisted with the typing of this thesis in draft, and Mrs* Baker typed part of the thesis in draft and the whole of it in the final form* These ladies were very under standing ,and each was quick to respond within the shortest possible notice* In particular, Mrs* Baker performed a remark
able feat in typing the thesis in its present form within six weeks*
Mention must also be made of Or* E.O. Pratt, Medical Offi
cer, Fourah Bay College, University of Sierra Leone, Dr* G.Stern, Neuro-Physician of University College, London, and Mr* I.McCaul, a Harley-Street Neuro-Surgeon, without whose medical skills this work would have come to a premature and tragic end in 1972 when I was taken ill*
Finally, my wife and family contributed in no small measure to making me comfortable, and they urged me on during moments of depression* Though not a lawyer, Mrs* Daisy Smart even took the trouble to help with the checking of the cases*
To all the above-mentioned persons and institutions> I owe much and I express my sincere thanks and appreciation*

TABLE OF CASES
Note on Sierra Leone^reporting
A great obstacle to anyone embarking on research into a Sierra Leone legal topic is the dearth of reported case-law.
Until 1969 when the African Law Reports (Sierra Leone series) were begun, law reporting in Sierra Leone has been negligible.
Throughout the long period of the country’s legal history, the only law reports have hitherto been (a) M.F.J. McDonnell's Sierra Leone Law Reports, 1912-1924 (one volume); (b) E.S.
Beoku-Bett's Sierra Leone Law Recorder, 1950 (three volumes);
and (c) Sierra Leone Law Reports, 1960-1963 (three volumes) published by Sweet & Maxwell, London. None of these reports contains sufficient material in any one area of Sierra Leone law
in order to kindle enthusiasm for research into that field.
Despite this obstacle, the present writer has tried to supple
ment the few Sierra Leone reported cases with unreported ones which he himself discovered, and he has drawn abundantly on rele
vant case-law from other Commonwealth countries, notably from Britain, from which much has been borrowed by the Sierra Leone Courts themselves.
