lntroduction

At the Round Table Conference which took place from 24th August till 2nd November 1949 agreement was reached bctween parties in so far that in tbe transfer of sovereignty by the King- dom of the NetherJands to thc Republic of the United States of Indonesia on 27th December 1949 thc territory of the Residency Ncw Guinea would not be included. In this respect thc following provision was made:

I. Jn clause 2 of the Charter of Transfer of Sovereignty it was agreed that tbc status quo of the Residency Ncw Guinea was to he maintained with the stipulation, "that within a yeaT from the date of transfer of sovereignty to the Republic of the United States of Indonesia thc question of the political status of Ncw Guinea he determined through negotiations between the Republic of the United States of Indonesia and the Kingdom of the Netherlands"

2. In tbe agreement concerning the assignment of Citizens it was stipulated in tbe note attacbed to it that in respect of the natio·

nality of tbe inhabitants of New Guinea, in case the sever·

eignty over this territory is not transferred to the Republic of tbe United States of Indonesia, notbing is decided in said agree- ment of assignment.

During the First Conference of Ministers in the frame of the Netherlands·lndonesian Union, which Conference was held from 25th March till 1st April, tbe discussions on the question N~w

Guinea resulted to have the negotiations which were to lead to the determination of the politica I status of Ncw G uineajlrian, meant in the Charter, prepared by a Committee to be set up to this end.

The Conference of Ministers of the partners in the Netherlands- Indonesian Union therefore passed a resolution of Ist April 1950 No. MC IjC /I/I/G.T. to set up Committee to th at end.

1. Instruction of (he Conunit(ee

The instruction of the Committee is embodied in tbe previously mentioned Resolution (of tbe First Conference of Ministers), reading as follows:

The Conierence of Ministers of the partners in the Netherlands- Indonesian Union, convened in a meeting at Jacarta on lst April 1950,

taking ioto consideration tbat cJause 2 of the Charter of Transfer of Sovereignty reads:

"Witb regard to tbc Residency of New Guinea it is decided:

Q. in view of tbc fact tbat is has not yet been possible to reconcile tbe views of tbe parties on New Guinea, which remains, there- fore, in dispute,

b. in view of tbe desirability of tbe Round Table Conference con- cluding succesfully on 2 November 1949,

c. in view of tbe important factors wbich should be taken iota account in settling tbc question of New Guinea,

d. in view of tbe limited research that has been undertaken aod compJeted with respect to tbe problems involved in tbc question of Ncw Guinea,

e. in view of tbe heavy task, witb which tbe Union partners wiU initially be confronted, and

f.

in view of tbe dedication of the parties to tbc principle of resolving by pcaceful and rea,onable mean, any difference, that may hereafter exist or arise between tbem,

that the status quo of tbe residency of New Guin .. shall be maintained witb the stipulation tbat witbin a year from tbe date of tr.nsfer of sovereignty to tbe Republic of tbe United Stales of Indonesi. tb. question of tb. political ,tatus of New Guinea be determined through negotiations between tbe Republic of tbe United States of Indonesia and tbe Kingdom of tbe Netberland,.

Considering that is is desirabie to have tbc negotiations wb1ch are to lead to tbe previously mentioned determination of the political status of New GuineafIrian prepared by a Committee to be set up to tbi, end.

Decides:

1. To set up a Committee to that end;

2. To decide tbat tbc Governmenls of the two partners shall each .ppoint tbree members of tbis Committee before 15tb April 1950;

3. Ta deeide that tbc Committee cao convene in thc Netherlands, lndonesia and New Guinea (lrian);

4. To authorize tbe Committee to eaU in the assistance of experts;

S. To request the Committee to present its report to the Govem·

menls of tb. two partners not later tban Ist Juli 1950;

6. To decide that tbe report of tbc Committee sball irnmediately be brought to tbe notiee also of tbe UNCI and tbat siso clause 6 of tbe Covering Resolution shall be taken into account;

7. To entrust tbe Secretariat of the said Committee to tbe Union Secretariat;

8. To cbarge tbe costs of tbis Cornrnittee to tbe Union;

9. To have the defiDitive negotiations referred to in clause 2 of tbe Charter of Transfer of Sovereignty take place at the second Union Conference of Ministers or at a conference of the Governrnents of the two partners to be speciaUy convened to this end in tbe course of this year;

10. Tc decide that tbe Govemments of the two partners shall conjointly give, as far as necessary. further instructions to this Committee.

2. Composition of the Commiltee

In accordance with tbe provision sub 2 Establishment·Resolution tbe Committee was to be composed on al Par.

For this purpose tbe Government of tbc Kingdom of tbe Netber- lands appointed (members of tbe Committee) Prof. Dr. G. H. van der Kolft, at the time professor of Politica I Economy at tbe Law University at Batavia, Prof. Dr. J. M. Pieters, Extraordinary Profes- sor of Overseas Economy, Polities and Law at tbe Roman Catholic Economieal Higbscbool at Tilburg and Prof. Dr. R. van Dijk, Professor of Sociology at tbc Free University at Amsterdam.

The Government of tbe Republic of tbe United States of Indonesia appointed Messr Dr. J. Latubarbary and Dr. Muh. Yamio, both members of tbe People's Representation of tbe Republic lndonesia Serikat and Dr. L. H. P. S. Makaliwy, Superior Official of tbe State Railways of tbe Republic Indonesia Serikat, members of tbe Com- mittee.

Owing to Mr. Muh. Yamins absence during the first week of tbe work of tbe Committee Dr. Teng Tjin Leng, also a member of the People's Representation of tbe Republic lndonesia Serikat, took the former's pi ace.

The UnioD Secretariat, entrusted witb tbe Secretariat of tbe Mixed Cornrnittee appointed Messr. Moh. Jahja and Dr. W. Schols secre- taries. Mr. A. S. Pello, later replaced by Dr. Teng TjiD Leng, was appointed secretary of tbe lndonesian Group, Dr. J. van Baal secre- tary of the Netberlands Group. Tbe Indonesian members assumed as their advisers Messr. S. Papare aod A. J. Latumahina. Messr. J.

A. van Beuge and N. Jouwe were tbe advisers to the NetherJands Group of members.

3. Work of ,he Com~ittee

In tbe series of meetings and gatherings three periods are to be distinguished:

I. The introduetory discussioDs at Jaearta from 5tb tilJ 17tb May 1950,

2. The orientation visit to New Guinea from 17th May tilt 5th June 1950, and

3. The final discussions from 5th till 9th June 1950 at Jacarta and from Zlst June till August 1950 at the Hague.

In the first period Standing Orders were drawn up. It was agreed that tbe Chairmansbip of the Commiuee should be entrusted in weekly rotation to Messr. Dr. I. Latuharbary and Prof. Dr. G. H.

van der Kolff. Furtber agreement was reached about tbe desirability that tbc members of the Committee could orientate tbemselves personally in New Guinea/Irian.

This visit of orientation lasted from 17th May tiU 5th Iune, during wbich period were visited Biak, Hollandia, Merauke, Wissel·

meren (Paniai), Serui, Manokwari and Sorong and tbeir vicinities.

Prominent persoos were contacted locally, i.a. heads of people, civil servants, leaders of parties aod associatioDs, representatives of tbe Missions, the Islam, and private enterprises.

Upon their return from this visit of orientation tbe now following discussions were held between the members in respect of an exchange of ideas about the plan and the contents of the report.

These discussions could bowever not lead to an agreement in respect of making a joint report. The standpoints of the !Wo groups proved to be fundamentaJly so far apart that no solution could b.

found which was acceptable to both groups. lt was therefore even·

tuaUy agreed that the !Wo groups wer. to present their own report independent from each other, definitively worded and to be ealled

"Main Constituent", which 2 main constituents witb this Preface aod the appendixes attacbed to tbe documents (the formalized mmu- tes and reports of fonner meetings and inlonnal gatherings, aod a1so the documents excbanged between tbc groups) were to be tbe report of the Committee, now beiog presented to tbe Goverrunents con·

cerned.

In deviation of tbe provision of tbe Standing Orders it was agreed that the two Main Constituents are to he worded by each of the groups in its own language; translations will be made by tbe Uoion Secretariat

The committee does not want to consider its task as finished before it has expressed its thanks to tbe many persons, Înstances aod insti·

tutions which have assisted tbe Committee in the carrying out of its work.

In partieular it presents its thanks to the two Governrnents, H.E.

the Governor of New Guinea, and also !he many persons who have during tbe visit of orientation to New Guinea/lriao declared them- selves willing to give the neeessary information. It is mueh indebted to the Garuda Indonesiao Airways aod the Roya! Dutch Airlines

(K.L.M.) and also to the Naval Airservice and its personnel who looked af ter the aerial transport in New Guinea. Finally a word of thanks is due to tbe Koninklijke Bibliotheek at the Hague, the Library of the Koninklijke Nederlandse Petroleum Maatschappij N.V. at the Hague, the Library of the Leyden University, the Library of the Peace Palace and other institutions which gave us Iiterature.
