6.2 Reflectie en aanbevelingen
In de uitvoering van dit onderzoek werd ik geconfronteerd met verschillende problemen. In hoofdstuk 3.3 zijn deze reeds besproken. Het grootste probleem in de uitvoering van dit onderzoek was de hoge non-respons. Er is een groot aantal partijen benaderd met het verzoek voor interviews (14 partijen) en het invullen van een questionnaire (circa 50 partijen). Desondanks waren slechts enkele partijen, met behoud van hun anonimiteit, bereid de questionnaire in te vullen en kon er slechts een interview, dat later geen relevante informatie bleek op te leveren, worden afgenomen. Deze hoge non-repons is een implicatie voor de grote belangen die er spelen rondom IPR. Dit sluit aan bij de
gebrekkige openbare informatie over de wijze waarop actoren hun IPR belangen proberen te behartigen en in welke mate dit de besluitvorming over IPR-beleid beïnvloed.
- 75 - focus op dit onderzoek nog meer moeten leggen op het beschrijven, in plaats van
verklaren, van de actoren en relaties in het sociale netwerk van de casus. In het beschrijven hiervan liep ik echter ook tegen problemen aan. Doordat er niet van alle actoren informatie beschikbaar was heb ik mijn onderzoek moeten toespitsen op actoren waarvan wel informatie beschikbaar was, respectievelijk de EU, Business Europe, EFPIA en NGO’s. Door de non-beschikbaarheid van significante informatie heb ik mijn
onderzoeksvraag niet voldoende kunnen beantwoorden.
Door de hoge non-response op de questionnaire zijn de resultaten van deze questionnaire niet representatief voor het sociale netwerk. Om de interne validiteit van dit onderzoek toch te waarborgen zijn de resultaten uit de questionnaire onderbouwd met de analyse van publicaties van actoren en de analyse van het historische netwerken in IPR- beleid.
Dit onderzoek is gedeeltelijk generaliseerbaar. De resultaten uit het onderzoek lijken, gezien de historische netwerken in IPR-beleid, aan te sluiten bij trends in de vorming van IPR-beleid. Grote machtige landen met een sterke farmaceutische industrie domineren IPR-beleid en proberen ontwikkelingslanden met een zwakke farmaceutische industrie hun TRIPS-standaarden op te leggen.
In dit onderzoek, konden gezien incomplete informatie en het nog niet hebben afgesloten van de EU-India FTA, echter geen uitspraken worden gedaan over de mate waarin de verschillende actoren ook daadwerkelijk invloed hebben op de inhoud van de FTA.
Het is in dat opzicht dan ook nuttig om vervolgonderzoek uit te voeren naar de vorming van FTA over patentrechten tussen machtige landen met een sterke
farmaceutische industrie, zoals de EU, VS en Japan, en landen met een zwakkere farmaceutische industrie, zoals Brazilië en China. Vooral het besluitvormingsproces over IPR waar een van de BRICS-landen bij betrokken zijn, zijn relevant om te onderzoeken. Deze landen bevinden zich in de transitie van puur consument van technologie naar ook producent van technologie en hebben daardoor ook in enige mate behoefte aan IPR- wetgeving. Daarnaast behoren deze landen tot de weinige ontwikkelingslanden die
(mogelijk) in staat zijn om significante hoeveelheden van betaalbare generieke medicijnen te produceren.
In vervolgonderzoek is het daarnaast belangrijk aandacht te hebben voor de rol van NGO’s. In dit onderzoek kon niet worden vastgeld of en via welke relaties NGO’s het besluitvormingsproces proberen te beïnvloeden. De analyse van historische netwerken in IPR toonden dat NGO’s geleidelijk een belangrijkere, maar nog steeds ondergeschikte, rol hebben gekregen in IPR-beleid. Echter, de onderhandelingen over de FTA zijn na jaren van onderhandeling nog steeds niet afgerond. Dit zou erop kunnen wijzen dat het
publieke protest tegen de FTA geïnitieerd door NGO’s effect heeft de positie van India in de onderhandelingen.
Om de invloed van NGO’s te onderzoeken is het belangrijk inzicht te verkrijgen in welke NGO’s betrokken zijn bij deze beïnvloeding en wat hun relaties onderling en met andere actoren zijn. Hiertoe is het belangrijk om inzicht te verkrijgen in de lobbyruimtes van NGO’s (en andere partijen) in het beïnvloeden van landen. In veel
ontwikkelingslanden staat het onderzoek naar lobbying nog in de kinderschoenen. Dit terwijl deze landen de enige actoren zijn die weerstand kunnen bieden aan TRIPS-plus standaarden en zo hun volksgezondheid kunnen beschermen. Het is dan ook noodzaak inzicht te verkrijgen in lobbying.
- 76 - methodes. Zowel het gebruik van een case study als etnografie is mogelijk. De actoren die een significante rol spelen in het beïnvloeden van het besluitvormingsproces van IPR- beleid zijn instituties. Instituties ontstaan door het verstollen en de formalisering van gedrag, ideeën, normen en waarden. De institutionalisering heeft invloed op de belangen en strategieën die actoren hanteren. Etnografie is een methode die een onderzoeker toestaat de gedeelde patronen van waarden, gedrag en overtuigingen binnen een cultuurdelende groep te onderzoeken. Moeilijkheid van etnografie is echter wel dat de onderzoeker de mogelijkheid moet hebben om het fenomeen in haar context te bestuderen. Hierdoor heeft zij toegang nodig tot een institutie betrokken bij onderhandelingen.
