Samenvatting
In de Wet publieke gezondheid (Wpg) is opgenomen dat het hoofd van het microbiologisch laboratorium aangifte doet van besmettelijke infectieziekten aan de Gemeentelijke of Gemeenschappelijke Gezondheids-dienst (GGD). In 2017 heeft het microbiologisch labo-ratorium van het Franciscus Gasthuis & Vlietland (FG&V) verzuimd om 33 aangifteplichtige infectieziek-ten aan de GGD te melden. Naar aanleiding van deze nalatigheid werd binnen het laboratorium de meldings-procedure aangepast, resulterend in het melden van gegevens conform de Wet publieke gezondheid. Van-wege de omvang van het verzuim werd hiervan door de senior inspecteur van de Inspectie Gezondheids-zorg en Jeugd in augustus 2018 aangifte gedaan bij het Openbaar Ministerie. In het opgestelde proces-verbaal werd verzocht om de toenmalig medisch mana-ger, als hoofd van het medisch-microbiologisch labora-torium, strafrechtelijk te vervolgen aangezien zijn nala-tig handelen een gevaar zou kunnen opleveren voor de volksgezondheid. In april 2019 werd door de Offi-cier van Justitie de zaak geseponeerd aangezien bin-nen het FG&V niet was vastgelegd dat binbin-nen de be-staande duale managementstructuur, de medisch ma-nager tevens hoofd was van het laboratorium. Naar aanleiding van deze ervaringen wordt een aantal
be-langrijke aanbevelingen gedaan voor
artsen-microbioloog inzake de in de Wpg opgenomen mel-dingsplicht.
Abstract
The Public Health Act (Wpg) states that the head of the microbiology laboratory is responsible for reporting notifiable infectious diseases to the Municipal Health Service (GGD). In 2017, the microbiology laboratory of the Franciscus Gasthuis & Vlietland (FG&V) failed to report 33 notifiable infectious diseases to the GGD. As a result of this negligence, the laboratory reporting pro-cedure
was changed resulting in the reporting of data in ac-cordance with the Wpg. Because of the extent of this failure, the senior inspector of the Health and Youth Care Inspectorate reported this to the Public Prosecuti-on Service in August 2018. In the official report, it was requested that the former medical manager, as head of the medical microbiology laboratory, be prosecuted as his negligent acting behavior could endanger public health. In April 2019, the case was dismissed by the Public Prosecutor since it was not specified that the medical manager was also the head of the microbiolo-gy laboratory within the existing FG&V dual manage-ment structure. As a result of these experiences, a number of important recommendations are made for the medical microbiologist with regard to the notificati-on requirement included in the Wpg.
Inleiding
De Wet publieke gezondheid (Wpg) schrijft voor dat
artsen en microbiologische laboratoria en hoofden van instellingen bepaalde infectieziekten moeten melden aan de GGD.[1] Door deze meldingsplicht is de Ge-meentelijke of Gemeenschappelijke Gezondheids-dienst (GGD) in staat om, door het nemen van gerichte maatregelen, de verspreiding van infectieziekten bin-nen de bevolking te voorkomen en daarmee de volks-gezondheid te beschermen. In 2017 is het microbiolo-gisch laboratorium van het Franciscus Gasthuis & Vlietland (FG&V) nalatig geweest in deze meldings-plicht, met als resultaat dat een deel van de in de Wpg opgenomen meldingsplichtige infectieziekten (MPI) in dat jaar niet bij de GGD is
