5. Geen consensus over de omzetting van de Europese richtlijn
De Europese Commissie heeft een groot aantal documenten uit de “Radiation Protection” reeks gewijd aan de NORM problematiek in de hoop om zo tot een uniforme aanpak in Europa te komen. Deze inspanning lijkt evenwel niet het gewenste resultaat op te leveren. Ondanks de vele leidraden groeit de aanpak van de lidstaten snel uit elkaar, en dit zowel op het vlak van regelgeving, vrijgave- en vrijstellingsgrenzen als van afvalproblematiek. Wat toegestaan is in één land is verboden in een ander. Dit kan op termijn leiden tot een verstoring van de Europese markt met migratie van industrieën naar landen met een minder strenge regelgeving. Ter illustratie van de toenemende disharmonie in de Europese Unie, het verschil in aanpak tussen Nederland (KB van 16 juli 2001) en België (KB van 20 juli 2001).

In Nederland worden beroepsactiviteiten (in Nederlandse reglementering werkzaamheden genoemd) geclassificeerd volgens het dosisschema beschreven in Radiation Protection 95 (1999). De indeling gebeurt op basis van volgende dosiscategorieën (van der Steen, 2004):
• Categorie A1: dosis onder normale en ongunstige omstandigheden: ≤ 0,1 mSv/jaar;
• Categorie A2: dosis onder normale omstandigheden: ≤ 0,1 mSv/jaar of onder ongunstige omstandigheden: 0,1 tot 1 mSv/jaar;
• Categorie B: dosis onder normale omstandigheden: 0,1 tot 1 mSv/jaar of onder ongunstige omstandigheden: 1 tot 6 mSv/jaar;
• Categorie C: dosis onder normale omstandigheden: 1 tot 6 mSv/jaar of onder ongunstige omstandigheden: 6 tot 20 mSv/jaar;
• Categorie D: dosis onder normale omstandigheden: 6 tot 20 mSv/jaar of onder ongunstige omstandigheden: 20 tot 50 mSv/jaar;
• Categorie E: dosis onder normale omstandigheden: > 20 mSv/jaar. Volgens de inventarisatiestudie van de NORM problematiek in de Nederlandse industrie komen de dosissen onder normale omstandigheden van de meeste beroepsactiviteiten niet boven de 0,1 mSv/jaar uit (categorie A). Een twintigtal beroepsactiviteiten vallen in categorie B omdat de dosissen onder normale omstandigheden liggen tussen 0,1 en 1 mSv/jaar. In categorie C komen er naast luchtvaart, die we in deze studiedag niet bespreken, maar drie beroepsactiviteiten voor:
• WIG (Wolfraam-Inert-Gas) lassen;
• Decontaminatie bij thermische fosforzuurproductie; • Decontaminatie van componenten bij olie- en gaswinning.
Nederland heeft een eigen stelsel van vrijstellings- en vrijgavegrenzen aangenomen met waarden die stuk voor stuk hoger zijn dan deze voorgesteld in Radiation Protection 122, deel II (2001). Ook het meldings- en vergunningssysteem voor beroepsactiviteiten is op deze hogere Nederlandse grenzen gebaseerd.

specifieke industriële activiteiten, met name: • de productie van fosfaten;
• de aanwending van zirkoniumzand; • de tingieterij;
• de extractie van zeldzame aarden en;
• de vervaardiging van elektroden voor las- en soldeerwerken die thorium bevatten.
Het FANC kan bovendien een dosisevaluatie opleggen voor elke andere beroepsactiviteit waarvan het agentschap van mening is dat de dosis vanuit het oogpunt van de stralingsbescherming niet mag worden verwaarloosd.

que la problématique NORM est complexe et qu’elle peut être rencontrée partout dans l’industrie non-nucléaire. Même les matériaux de base ayant une radioactivité naturelle normale peuvent, par enrichissement, conduire à de fortes concentrations dans les sous-produits ainsi que dans les déchets. L’AR du 20 juillet 2001 se réfère aux activités professionnelles impliquant des sources naturelles de rayonnements ionisants lorsque les radionucléides ne sont pas traités en raison de leurs propriétés radioactives et dont la dose ne peut être négligée du point de vue de la radioprotection. Pour les personnes professionnellement exposées à des matières naturellement radioactives de provenance industrielle, la réglementation est d’application à partir d’une dose de 1 mSv/an en excès de la dose de fond. Les nombreuses possibilités d’exposition entre et à l’intérieur des industries, la diversité des mesures possibles à utiliser pour réduire cette exposition et le grand nombre de sites historiques contaminés par des matériaux NORM compliquent l’application de cette réglementation.
Il n’y a pas de consensus international sur les valeurs d’exclusion, d’exemption et de libération pour les radionucléides naturels. Les valeurs d’exclusion suggérées dans le projet de recommandations générales de la CIPR sont plus élevées que les valeurs d’exemption et de libération publiées dans “radiation protection” 122, partie II, de la Commission Européenne. Les calculs de scénario pour déterminer les valeurs Européennes étaient basées sur un critère dosimétrique de 0,3 mSv/an. Ce qui est 30 fois plus élevé que le niveau trivial de 0,01 mSv/an pour dériver les valeurs d’exemption et de libération des sources humaines de rayonnements.
Summary
The various contributions to this workshop illustrate the complexity of the NORM issue which can arise almost everywhere in the non-nuclear industry. Even ores with a normal natural radioactivity may concentrate the radionuclides up to high specific activities in by-products and residues. The Royal Decree of 20 July 2001 introduces in this context work activities as natural radiation sources not used for their radioactive properties and leading to a significant increase in the exposure which cannot be disregarded from the radiation protection point of view. The regulation applies for an excess occupational exposure above background of 1 mSv/year. The wide range of possible exposure situations between and even within industries,

the various measures one can take to decrease the exposure and the many historical sites contaminated with NORM materials make it not easy to implement this regulation in practice.
There is still no international consensus on the exclusion, exemption and clearance levels for natural radionuclides. The exclusion levels suggested in the draft ICRP recommendations are higher than the exemption and clearance levels suggested in Radiation Protection 122, part II, of the European Commission. The scenario calculations to derive the European levels were based on a dose criterion of 0.3 mSv/year. This is 30 times higher than the trivial dose level of 0.01 mSv/year for the derivation of the exemption and clearance values for artificial radionuclides.
