33 legitimacy critiques of the international investment system, but if it does, other legitimacy issues related to the role of arbitrators in developing environmental norms will be sure to emerge simultaneously.

All in all, through using the positivist and social approaches, this thesis has been able to lay bare the underlying currents with regards to what might be perceived as a purely legal development in the context of environmental counterclaims. It has illustrated how adding a sociological approach to the concept of authority might alter our understanding of IIATs and how individual actors might play a significant role in shaping the direction of substantive developments in international investment arbitration.
