1.0.0 23-03-2021 Naar aanleiding van de BREXIT is een certificaat ontwikkeld ten behoeve van de export van waterdieren voor sierdoeleinden voor gesloten

siervisvoorzieningen naar Groot-Brittannië. Deze instructie en het

bijgevoegde certificaat beschrijven de eisen en de bijbehorende dekkingen voor het afgeven van dit certificaat.

1 DOEL EN TOEPASSINGSGEBIED

Deze instructie geldt voor het exporteren van waterdieren voor sierdoeleinden voor gesloten

siervisvoorzieningen naar Groot-Brittannië. De instructie beschrijft de voorwaarden die gelden voor de invoer in Groot-Brittannië, de controles die de NVWA hiervoor moet uitvoeren, en de gegevens die het bedrijfsleven moet aanleveren aan de NVWA. Van deze instructie kan niet worden afgeweken.

3 DEFINITIES

Groot-Brittannië : Dit is het complete eiland dat bestaat uit de landen Engeland, Schotland en Wales. Ook de kleinere eilanden die direct om het hoofdeiland heen liggen zoals de Orkney Islands, de Shetland Islands en het eiland Wight worden bij Groot-Brittannië gerekend. De Kanaaleilanden en het Isle of Man horen niet bij Groot-Brittannië.

Verenigd Koninkrijk : Het Verenigd Koninkrijk bestaat uit de landen van Groot-Brittannië

(Engeland, Schotland en Wales) plus Noord-Ierland. De volledige naam in het Engels is The United Kingdom of Great Britain and Northern Ireland.

Kanaaleilanden en

Isle of Man : De Kanaaleilanden (Channel Islands) horen officieel niet bij Groot-Brittannië of het Verenigd Koninkrijk. De eilanden Jersey, Guernsey, Herm, Alderney en Sark vormen een zogeheten ‘crown dependency’ (autonome bezitting van de Britse kroon). Dit geldt ook voor het Isle of Man in de Ierse Zee. Het

staatshoofd van de Kanaaleilanden en het eiland Man is de Britse koningin, maar dan in haar hoedanigheid van respectievelijk de Hertogin van

Normandië en de Lord of Mann.

door het risico van de overdracht van ziekten naar de natuurlijke wateren tot een aanvaardbaar niveau wordt teruggebracht.

4 WERKWIJZE

De export van waterdieren voor sierdoeleinden voor gesloten siervisvoorzieningen naar Groot-Brittannië is toegestaan.

• Certificaat: zie bijlage Toelichting bij het certificaat:

Algemeen:

- Het certificaat is beschikbaar in het systeem e-CertNL.

- Het certificaat dient niet te worden geprint op waardepapier, maar op blanco papier.

- Verwijzingen naar Groot-Brittannië in de instructie en/of het certificaat omvatten tevens de export naar de Kanaaleilanden en het Isle of Man.

- Raadpleeg vooraf de instructie Tijdelijke Maatregelen Derde Landen (TMDL-01) op mogelijke

exportbeperkingen. Als in de TMDL-01 informatie staat die in strijd is met een landeninstructie dan is de informatie vermeld in de TMDL-01 leidend.

HEALTH ATTESTATION Verklaring 1.:

General requirements

I, the undersigned official inspector, hereby certify that the ornamental aquatic animals referred to in Part I. of this certificate:

Verklaring 1.1:

Have been inspected within 72 hours of loading, and showed no clinical signs of disease;

Deze verklaring kan worden afgegeven op basis van een klinische inspectie in de zwemomgeving ter plaatse binnen 72 uur door de certificerende NVWA-dierenarts/inspecteur.

Verklaring 1.2:

Are not subject to any prohibitions due to unresolved increased mortality; and

Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving en na controle of het bedrijf niet geblokkeerd is.

Verklaring 1.3:

Are not intended for destruction or slaughter for the eradication of diseases;

Deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving.

Verklaring 2:

Either ⁽¹⁾⁽⁴⁾ Originate from a country/territory, zone or compartment declared free from [EHN]⁽¹⁾ [Bonamia exitiosa]^{(1) [}Perkinsus marinus]⁽¹⁾[Mikrocytos mackini]⁽¹⁾[Taura syndrome]⁽¹⁾ [Yellowhead disease]⁽¹⁾ in accordance with the relevant OIE Standard by the competent authority of the country of origin, or via a process equivalent to Decision 2009/177, and (i) Where the relevant disease(s) is (are) notifiable to the competent authority and

reports of suspicion of infection of the relevant disease(s) must be immediately investigated by the competent authority;

(ii) All introduction of species susceptible to the relevant disease(s) come from an area declared free of the disease(s);

Deze verklaring is alleen van toepassing indien het voor één van deze dierziekten gevoelige soort(en) betreft. Zie bijlage 2 voor de gevoelige soorten per dierziekte, behorende bij verklaring 2. Zie voor alle dierziekten de meest actuele versie van Richtlijn 2006/88, Bijlage IV part II.

Indien het NIET één van de soorten betreft die genoemd worden in bijlage 2, dan zijn het geen gevoelige of vatbare soorten en kan verklaring 2 in z’n geheel worden doorgehaald. Belanghebbende moet een lijst met de te exporteren vissoorten aanleveren.

Indien de te exporteren vissen gevoelig zijn voor één of een deel van de genoemde dierziekten, is deze verklaring van toepassing. De optie die niet van toepassing is, moet worden doorgehaald.

Bij de eerste optie van deze verklaring moeten de dierziekten die niet van toepassing zijn worden doorgehaald.

Deel (i) van de eerste optie van deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving.

Deel (ii) van de eerste optie van deze verklaring kan worden afgegeven na controle van de

dierziektesituatie van het land van oorsprong. Indien de vis geïmporteerd is uit derde landen, kan dit gecontroleerd worden aan de hand van de importdocumenten (Gemeenschappelijk Document van Binnenkomst (GDB) en het gewaarmerkt certificaat (dit mag ook een kopie zijn)).

Deel (iii) van de eerste optie van deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving.

Tot op heden is er geen officiële lijst van quarantainevoorzieningen voor siervissen in Nederland bekend.

Deze optie kan worden doorgehaald indien het bestemmingsadres een erkende quarantaine faciliteit is.

Belanghebbende moet dit aantonen. Dit kan worden aangetoond d.m.v. deze link: Public register of Aquaculture Production Businesses in England and Wales (cefas.co.uk).

Verklaring 3:

N.B.: Koikarpers zijn gevoelig voor een dierziekte genoemd in verklaring 3 (KHV). Ook de 10-potige kreeftachtigen zijn gevoelig voor een dierziekte (White spot disease).

Deel (i) van de eerste optie van deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving.

Deel (ii) van de eerste optie van deze verklaring kan worden afgegeven na controle van de

Verklaring 4:

Transport and labelling requirements

I, the undersigned official inspector, hereby certify that:

Verklaring 4.1.:

The ornamental aquatic animals referred to above are placed under conditions, including with a water quality, that do not alter their health status;

Verklaring 4.2.:

The transport container is clean and disinfected or previously unused;

Verklaring 4.3.:

The consignment is identified by a legible label on the exterior of the container with the relevant information referred to in Part II. and Part III. of this certificate, and the following statement:

Either⁽¹⁾ “Ornamental [fish](1) [molluscs](1) [crustaceans](1) intended for closed ornamental facilities in Great Britain”;

Or⁽¹⁾ “Ornamental [fish]⁽¹⁾ [molluscs]⁽¹⁾ [crustaceans]⁽¹⁾ intended for quarantine in Great Britain”;

De optie die niet van toepassing is, moet worden doorgehaald.

Bij beide opties moeten de soorten die er niet inzitten worden doorgehaald. Bijvoorbeeld als het geen mosselen en garnalen betreft, moeten deze twee doorgehaald worden.

Deze verklaring kan afgegeven worden na controle van het etiket. Op het etiket moet het volgende staan:

• Het land met de ISO-code, de regio en plaats van oorsprong (inclusief de NAW-gegevens van het bedrijf) ;

• Het land met de ISO-code en de regio van bestemming: Groot-Brittanië (GB);

• Place of loading;

• De zin wat van toepassing is uit deze verklaring, bijvoorbeeld: “Ornamental Fish intended for closed ornamental facilities in Great Britain”

Verklaring 5:

(a) Where [SVC]⁽¹⁾[GS]⁽¹⁾[BKD]⁽¹⁾[IPN]⁽¹⁾ is (are) notifiable to the competent authority and

(b) Where all introduction of species susceptible to the relevant disease(s) comply with the requirements set in Part IV.5 of this certificate;

(c) Where species susceptible to the relevant disease(s) are not vaccinated against the relevant disease(s);

(d) Which comply with the requirements for disease freedom as regards [SVC]⁽¹⁾[GS]⁽¹⁾ [BKD]⁽¹⁾[IPN]⁽¹⁾ laid down in the relevant OIE standard or at least equivalent to the process in Decision 2009/177;

Or⁽¹⁾⁽³⁾ Have been subject to quarantine under conditions at least equivalent to those laid down in Decision 2008/946/EC;

Deze verklaring is alleen van toepassing indien het voor één van deze dierziekten gevoelige soort(en) betreft. Zie bijlage 4 voor de gevoelige soorten per dierziekte, behorende bij verklaring 4. Zie voor alle dierziekten de meest actuele versie van Verordening (EG) nr. 1251/2008, Bijlage II deel C.

N.B.: Goudvissen en karpers zijn gevoelig voor SVC.

Indien de te exporteren vissen gevoelig zijn voor één of een deel van de genoemde dierziekten, is deze verklaring van toepassing. De optie die niet van toepassing is, moet worden doorgehaald.

Bij deel (a) van de eerste optie van deze verklaring moeten de dierziekten die niet van toepassing zijn worden doorgehaald. Deel (a) van de eerste optie van deze verklaring kan voor wat betreft SVC worden afgegeven op basis van EU- en nationale regelgeving. De overige drie dierziekten zullen niet van

toepassing zijn en moeten worden doorgehaald, aangezien dit alleen voor zalmachtigen en forellen geldt.

Deel (b) van de eerste optie van deze verklaring kan worden afgegeven na controle van de

importdocumenten. Voor import uit derde landen moet het GDB met het gewaarmerkt certificaat (zie ook II.2 en II.3) hiervoor door de belanghebbende overlegd worden.

Deel (c) van de eerste optie van deze verklaring kan worden afgegeven. Er wordt niet gevaccineerd.

Deel (d) van de eerste optie van deze verklaring kan worden afgegeven op basis van EU- en nationale regelgeving.

Verklaring 6:

(1)(7)Requirements for species susceptible to OsHV-1 μvar

Either⁽¹⁾ Originate from a country/territory, zone or compartment:

(a) Where OsHV-1 μvar is notifiable to the competent authority and reports of suspicion of infection of the relevant disease must be immediately investigated by the competent authority,

(b) Where all introduction of species susceptible to OsHV-1 μvar comply with the requirements set out in II.6 of this certificate, and which comply with requirements for disease freedom equivalent to those laid down in in Decision 2009/177;

And/or⁽¹⁾Have been subject to quarantine under conditions at least equivalent to those laid down in Decision 2008/946/EC;

Deze verklaring is alleen van toepassing indien het Japanse oesters betreft. Voor OsHV-1 μvar (Ostreid Herpesvirus): zie op de OIE-website,

Indien het Japanse oesters betreft, kan er gekozen worden uit a t/m b óf quarantaine. Doorhalen wat niet van toepassing is.

(a): deze verklaring kan afgegeven worden op basis van EU- en nationale regelgeving, OsHV-1 μvar is een aangifteplichtige ziekte.

Besluit 2009/177.

In plaats van a-b biedt het certificaat ook de mogelijkheid tot officiële quarantaine. In dit geval zou a-b doorgehaald kunnen worden. Hier zijn echter tot op heden geen officiële lijsten van bekend.

Voor Japanse oesters die bestemd zijn voor een officiële quarantaine faciliteit in Groot-Brittannië geldt deze verklaring niet. Dit kan worden aangetoond door middel van deze link: Public register of Aquacul- ture Production Businesses in England and Wales (cefas.co.uk).

Indien de te exporteren Japanse oesters bestemd zijn voor zones of compartimenten in Groot-Brittannië die niet vrij zijn voor de genoemde ziektes of waar geen bewakings- of uitroeiingsprogramma’s uitge- voerd worden dan geldt verklaring 8 niet.

5 BEVOEGDHEDEN EN VERANTWOORDELIJKHEDEN

De NVWA-dierenarts is bevoegd en verantwoordelijk voor het afgeven van het certificaat.

And/or(1) Have been subject to quarantine under conditions at least equivalent to those laid down in Decision 2008/946/EC.

Notes:

- Those countries subject to the transitional import arrangements include: an EU member State;

Liechtenstein; Norway, Iceland, Switzerland and Faroe Islands.

- References to Great Britain in this certificate include Channel Islands and Isle of Man.

- European Union legislation within this certificate are references to direct EU legislation which has been retained in Great Britain (retained EU law as defined in the European Union (Withdrawal) Act 2018).

Part I-III:

- Use the appropriate Harmonised System (HS) codes of the World Customs Organisation of the following headings: 0301, 0306, 0307, 0308 or 0511.

- Quantity: give the total number in kg, except for the ornamental fish.

- Commodity certified for: Use the option "Pets" for ornamental aquatic animals intended for pet shops or similar businesses for further sale, "Circus/exhibition” for ornamental aquatic animals intended for exhibition aquaria or similar businesses not for further sale and "Quarantine" if the ornamental aquatic animals are intended for a quarantine facility.

(2) Part 2. and 3. of this certificate only applies to species susceptible to one or more of the diseases referred to in the heading of the part concerned. Susceptible species are listed in Annex IV part II to Regulation (EC) 2006/88.

(3) Consignments of ornamental aquatic animals may be imported regardless of the requirements in part 2.

and 4. if they are intended for a quarantine facility complying with the requirements laid down in Decision 2008/946/EC.

(4) To be authorised into Great Britain one of these statements must be kept if the consignments contain species susceptible to EHN. Bonamia exitiosa, Perkinsus marinus, Mikrocytos mackini, Taura syndrome and/or Yellowhead disease.

(5) To be authorised into Great Britain, zone or compartment declared free from VHS, IHN, ISA, KHV, Marteilia refringens, Bonamia ostreae, or Whitespot disease or with a surveillance or eradication programme drawn up, one of these statements must be kept if the consignment contains species susceptible to the disease(s) for which disease freedom or surveillance or eradication programme(s) apply(ies). (6) Part 5. of this certificate only applies to consignments intended for Great Britain or part thereof which is regarded as disease-free, or subject to a surveillance or eradication programme as regards SVC, BKD, IPN or GS, and the consignment comprises species listed in Schedule 1 to The Aquatic Animal Health (England and Wales) Regulations 2009 or The Aquatic Animal Health (Scotland) Regulations 2009 as susceptible to the disease(s) for which the disease-free status or programme(s) apply(ies).

Part 5. also applies to consignments of fish of any species originating from waters where species listed in Schedule 1 to The Aquatic Animal Health (England and Wales) Regulations 2009 or The Aquatic Animal Health (Scotland) Regulations 2009 as species susceptible to infection with GS, are present, where those consignments are intended for Great Britain or part thereof listed in Annex I to Decision 2010/221/EU as free of GS.

Consignments of ornamental aquatic animals for which SVC, IPN and/or BKD related requirements are applicable, may be imported regardless of the requirements in part 5. of this certificate if they are intended for a quarantine facility complying with the requirements laid down in Decision 2008/946/EC.

(7) Part 6. of this certificate only applies to consignments intended for Great Britain or part thereof which is regarded as disease-free, or subject to a surveillance or eradication programme for OsHV-1 µvar, and the consignment comprises species listed in Part C of Annex II to Regulation (EC) No 1251/2008 as

susceptible to OsHV-1 µvar.
