Evaluation of the introduction of written victim impact statements (Kool, Passier and Beijer)

Victims of serious crimes may now draw up a written victim impact statement (SSV) for the judge to read out in court. Victims were recently also granted the right to speak.

The evaluation shows amongst other things:

¾ the SSV is not being used in all cases that would qualify for its use. The right to speak is also used very sparingly;

¾ the SSV is welcomed by the court, although a well-prepared oral delivery may make an even stronger impression;

¾ both the SSV and the right to speak in court may influence the judge’s decision, albeit as regards the penalty imposed.

Evaluation of victim-offender meetings (Hissel, Jansen, Soethout and Tromp)

In the ‘victim-offender meetings’ project, people who have fallen victim to a violence or property offence may meet with ‘their’ offender, based on the assumption that this will help the victims to come to terms with the offence more quickly, or in a better or more effective manner.

The study showed amongst other things:

¾ very few meetings were actually realised (37 instead of 250);

¾ reasons for the above included that volunteers did not always propose the option of meeting with the offender;

¾ victims who had met with ‘their’ offender said that this helped them come to terms with what has happened;

¾ occasionally, the Public Prosecutor would take the outcome of the meeting into account in the criminal proceedings. The mediation, however, should be entirely separate from the formal judicial route. In some cases this led to disappointment on the victim’s part.

Satisfaction of victims (Koolen, van der Heide and Ziegelaar)

In this survey almost 2000 victims from five police regions were asked how satisfied they were with police and justice.

The survey yielded a number of results, including:

¾ victims rate the police higher (6.7) than the Public Prosecutor (5.9) and the court (5.9). Victim Support Netherlands is rated the highest with a 7.0;

¾ the satisfaction of victims decreases as the seriousness of the offence increases and the financial damage incurred increases;

¾ the information supply from the police and the public prosecutor could be improved.

A study is currently being carried out to better determine underlying factors of satisfaction.

Current survey Victims and tort law

What do victims and their relatives and friends expect from tort law and what are their expectations related to? This concerns, for example, victims of traffic or work-related accidents and medical errors.

2 Needs of victims of crimes

We know from research that victims have different needs for information (regarding the police investigation for example), consultation (for example about giving information to the press), being heard (by the judge), compensation/ redress (both material and immaterial), and support and understanding from third parties.

But what are the biggest needs and are there any differences between victims of different offences? A systematic review combines the results from previous studies.

Damage schemes for victims

How is the scheme for the compensation of damages for victims of crime arranged in practice?

¾ schemes for compensation of damages by policy and Public Prosecutor ;

¾ will the injured party be joining in criminal proceedings?

What are factors for success and failure in the implementation of a compensation scheme, and what are the reasons behind the Court’s choice to allocate (or not to allocate) the claims for civil damages that have been joined in the criminal proceedings?
