STELLINGEN

PROPOSITIONS

relating to the dissertation Interpretation of Fundamental Rights in a Multilevel Legal System – An analysis of the European Court of Human Rights and the Court of Justice of the European Union by Hanneke Senden November 8, 2011

1. Internal comparative interpretation and external comparative interpretation generally require a different justification.

2. Even though teleological interpretation is widely used by both European courts, it often remains unclear what the object and purpose of a specific provision really entail.

3. Evolutive interpretation should be regarded as an interpretative principle distinct from, but related to the method of comparative interpretation.

4. Even though it is a highly debated method of interpretation, comparative inter- pretation is a valuable method of interpretation in a multilevel legal context.

5. The binding nature of the Charter of Fundamental Rights may increase the need for the Court of Justice of the European Union to be more explicit about its interpretative choices and interpretative techniques.

6. The distinction between interpretation methods and interpretative principles is helpful in getting a proper understanding of the whole interpretative framework applied by the Court of Justice of the European Union and the European Court of Human Rights.

7. Due to the strong reliance by the European Court of Justice on the case law of the European Court of Human Rights it would be beneficial to both if the latter pays more attention to its interpretative reasoning.

8. More attention should be paid to the interpretative phase in judicial reasoning, as it forces judges to be clearer about the scope of fundamental rights.

9. Whether a PhD is ever really finished is a matter of interpretation.
